  Article 1 [Purpose]
 
This User Agreement is an agreement between individual users (hereinafter ¡®User¡¯) and INix Soft Co.Ltd (hereinafter ¡®Contents provider¡¯) for the use of 'KalCash' while playing KalOnline a MMORPG (Massively Multiplayer Role Playing Game) provided by Contents Provider.
  Article 2 [Validity and Modification of Agreement]
 
1. The terms of this agreement are susceptible to change by posting of notification in the website
  or sending an e-mail to the user.
2. Provided that the Contents provider has reasonable grounds, the Contents provider Contents
  provider has the right to change all or portion of the terms of this agreement.?
3. The User is deemed to have agreed to this User Agreement by visiting the game website
  (www.Kalonline.com) and checking the updates regularly.
  Contents provider shall not be held responsible for any loss to the User caused by not checking
  the notifications.
4. Details that are not included in this Agreement shall be in accordance with the rules and regulations
  prescribed by KOREAN LAW.?
5. Important modifications to the user rights and responsibilities shall be notified online?and
  effective 5 days after the notification.?
 
  Article 3 [Terms and Definitions]
 
1. 'KalCash' is for the purpose of using paid services of KalOnline Item Shop.
  'KalCash' is a virtual currency provided by the Contents provider for KalOnline members to use
paid services of KalOnline.
2. 'Refill' means the purchase of 'KalCash' by Credit Card (VISA, MASTER), PaybyCash,
  ClickandBuy and Wire Transfer.
  The 'KalCash' you have purchased will be deposited in theKalOnline(www.Kalonline.com) account
3. 'Item Shop' (www.Kalonline.com) is a paid service for selling game items.
4. ''Kal Point' is KalCash provided by the Contents provider free of charge.
  Article 4 [Application Method]
 
1. All users (for using Kalcash) must provide correct and complete information in all required fields
  in the application form.
2. ¡®User¡¯ must fill the correct information and Contents provider regards the information as true.
  Article 5 [The protection of personal information]
 
1. Contents provider shall use the personal information of its members only for the purpose of
  providing the services described in this User Agreement, and shall not provide the personal
  information to a third party without the user's consent. Except, the personal information may be
  disclosed in the following cases:
 
(1) When there is a request from a law enforcement agency for the purpose of criminal
investigations in accordance with relevant laws.
(2) When there is a request from a government agency in accordance with the procedures
prescribed by relevant laws.
2. Other matters related to the protection of personal information shall be in accordance with
  Contents provider 's 'Policy on the Protection of Personal Information'.
  Article 6 [The consumption of KalCash]
 
1. User has put KalCash to use in allowed contents. But, Contents provider may not provide
  the service by user's request or Contents provider's needs.
2. Contents provider is not responsible for the impossible case of service as act of Providence.
  (System error and etc.)
3. User may be eligible to receive compensation for any losses which result from the content's
  damage, injury and elimination by a serious flaw in the service.
4. The balance of Kalcash is not beared interest in your account.
5. ¡®Kal Point¡¯ that Contents provider offered for events are good to the 31st of December
  every year, then will be deleted by itself
  Article 7 [Restrained Policy]
 
In under case, Contents provider may restrain user's account and delete Kalcash (in user's account).
1. Hacking and overwork behavior to the system
2. Trade or transfer the right of Kalcash to others
3. An illegal act of using another's credit card
4. Abnormal behavior including attempt to using other's account
5. An act of using gift items which was bought by illegal charge.
  (Ex: Using stolen Credit Card, Hacking, etc)
6. In additional case of Restrained account by a breach of C/S policy
  Article 8 [KalCash Refill]
 
1. A KalOnline account is required to refill KalCash.
2. KalCash is defined as Gold Kal cash, Silver Kal cash and Kal Point. The details is as
  follows,

3. Remaining Kalcash charged before Gold and Silver Kalcash system will be regarded as
  Gold Kalcash.
4. In case of Kal Cash charged in an error by user¡¯s negligence, contents provider should
  not guarantee.
5. KalCash can be refilled by credit card, Paybycash, Wiretransfer and Clickandbuy.
6. Users paying are considered to have agreed to the terms of service (or agreement) of each
  clearing corporation.
7. Kal Cash can be refilled in the following case

9. A monetary unit for Credit card, PayByCash and Wire Transfer are USD, In case of Clickanbuy is
  EURO.
  Article 9 [Approval of Kal Cash Payment]
 
1. The Contents provider has the right to deny user request or cancel approved membership
  in the following cases:
 
(1) When the User failed to pay the fee, or when the payer cannot be identified.
(2) When the User use a stolen credit card.
(3) When it's deemed impossible to accept due to other reasons provided by the User.
2. The Contents provider has the right to suspend the approval until the problem is solved in the
  following cases:
 
(1) When considerd impossible to provide adequate services due to lack of service facilities.
(2) When there are service errors.
  Article 10 [Kalcash transfer & Item Gift]
 
1. Definitely, The Kalcash transfer is not allowed. However, user can give a present for a gift
  (not Kalcash).
2. Contents provider can change the purchase's limit.
3. In case of gift transferred in an error by user¡¯s negligence, contents provider should not guarantee.
  However, in case of malfunction, contents provider should assure the reward.
  Article 11 [The available period of KalCash]
 
1.

Kal cash remaining in account and website not logged in over six months will be deleted.

  Article 12 [Refund]
 
1. Kalcash is refundable if user applied in the following case, according to the standard procedures.
 
(1) When there were no contents for using after purchasing Kalcash.
(Except, a good excuse to maintenance or already noticed)
(2) When the service was over as a inevitable case, any Kalcash that's left over are refundable.
(3) Kalcash can be refundable by its employees in case of misconduct by other members.
2. When one of it applies to Article 12, clause 1, user who want to refund should accept applications
  according to the Contents provider's procedures.
  If that happens, Contents provider should refund money to user who has a fair reason after
  closer inspection.
3. Except in the case Article 12, Clause 1 Kalcash is non-refundable under all circumstances.
  The usual: In respect of permanently restrained account by agreement, Kalcash agreement or
  C/S policy, any Kalcash that's left over are non-refundable.
  Article 13 [Service Suspensions]
 
1. The Contents provider can stop KalCash service in the following case.
 
(1) When it's unavoidable due to system repair or construction.
(2) When the telecommunications service is suspended by the telecommunications provider
licensed in accordance with the telecommunications Business Act.
(3) When there are unavoidable reasons.
2. The Contents provider has the right to limit or suspend some or all of the services when it's
  deemed unable to provide the services.
  Article 14 [Exemption from Responsibility]
 
1. Contents provider shall not be held responsible when it's regarded unable to provide the
  services due to overwhelming problems such as natural disasters.
2. Contents provider shall not be held responsible for the User's own problems that disrupt
  the services.
3. Contents provider shall not be held responsible for the User's loss of profit and any other
  losses to the User caused by the data obtained through the services.
4. Contents provider shall not be held responsible for the reliability and accuracy of the
  information provided by the members.
  Article 15 [Competent Court]
 
1. Legal disputes over fees and services shall be submitted to the competent court in
  accordance with the Korean court.
